Terms and Conditions

By accessing or using DeadJim's monitoring services ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User" or "you") and DeadJim ("we," "us," or "our").

DeadJim provides monitoring services that:

• Monitor system availability through periodic heartbeat signals
• Send notifications when systems become unresponsive
• Provide dashboard access for monitoring status
• Support multiple notification methods (email, SMS)

The Service is designed primarily for power outage detection and basic system monitoring.

RED SHIRT (Free Tier)

• Monitor 1 agent location
• Email alerts with standard delivery
• Dashboard access
• Community support

ENGINEER ($5/month)

• All RED SHIRT features
• Instant email alerts
• Priority support
• Advanced monitoring options

BRIDGE CREW ($7/month)

• All ENGINEER features
• SMS alert notifications
• Monitor up to 3 agent locations
• Premium support with phone options

To use our Service, you must:

• Be at least 18 years old or have parental consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update account information when it changes
• Be responsible for all activities under your account

You may not create multiple accounts to circumvent service limitations.

For paid tiers:

• Payments are processed monthly in advance
• All fees are non-refundable except as required by law
• We use Stripe for secure payment processing
• You authorize automatic renewal unless cancelled
• Price changes require 30 days advance notice
• Failed payments may result in service suspension

You may cancel your subscription at any time. Service continues until the end of the current billing period.

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to monitor systems you don't own or have permission to monitor
• Attempt to reverse engineer, hack, or compromise our systems
• Send excessive or abusive requests that may overload our infrastructure
• Use the Service for any illegal activities or to violate others' rights
• Share your account credentials with unauthorized parties
• Interfere with other users' use of the Service

While we strive for high availability:

• We do not guarantee 100% uptime or availability
• Planned maintenance may temporarily interrupt service
• We are not liable for downtime beyond our reasonable control
• Service levels may vary by tier (FREE vs. paid plans)

We maintain service level objectives and will communicate significant outages via our status page and email notifications.

Your privacy is important to us. Please review our Privacy Policy for details on:

By using our Service, you consent to data processing as described in our Privacy Policy.

The Service and all related content are owned by DeadJim and protected by intellectual property laws. You may not:

• Use our trademarks or branding without permission
• Create derivative works based on our Service
• Remove copyright or proprietary notices

You retain ownership of any data you provide to the Service.

IMPORTANT: To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• We are not responsible for losses due to system downtime or failed alerts
• You should not rely solely on our Service for critical monitoring needs

Some jurisdictions do not allow certain liability limitations, so these may not apply to you.

You agree to indemnify and hold DeadJim harmless from claims, damages, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third party rights
• Any content or data you provide to the Service

Either party may terminate this agreement:

• You may: Cancel your account at any time through your dashboard
• We may: Suspend or terminate accounts for Terms violations
• Effect: Termination ends your right to use the Service
• Data: We may delete your data after termination as described in our Privacy Policy

Provisions regarding liability, indemnification, and intellectual property survive termination.

We may modify these Terms by:

• Posting updated Terms on this page
• Providing email notification of material changes
• Giving at least 30 days notice before changes take effect

Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of Ontario, Canada without regard to conflict of law principles. Any disputes will be resolved through:

• Binding arbitration where permitted by law
• Courts of competent jurisdiction in Ontario, Canada
• English language proceedings

If any provision of these Terms is found unenforceable, the remainder remains in full force and effect. Unenforceable provisions will be modified to reflect the parties' intent to the maximum extent possible.
